In this Agreement, the “Customer” is the person who places an Order with FlexFridge (either as a private consumer or as a business);
means any item sold or supplied by FlexFridge under an Order;
means FlexFridge.com (FlexFridge), a company incorporated in the United States with patent number 9,217,598
means any request or purchase of Goods via phone or web, and;
refer to the Customer and FlexFridge.
1.1 The Customer is responsible for ensuring that the item/s ordered is of the appropriate spec, dimension, and conditions for their needs.
2.1 Standard delivery will occur between 8.00 am – 5.30 pm, Mondays to Fridays, except bank and regular holidays.
2.2 FlexFridge will use reasonable actions to deliver the goods within the time frame agreed by both parties when the Customer placed an order. If no time is approved, then FlexFridge will deliver within a reasonable time. If despite those endeavors, FlexFridge is unable, for any reason, to fulfill any delivery or performance on the delivery date, FlexFridge will not be deemed for breach of the Contract. Additionally, FlexFridge will not have any liability to the Customer for direct, indirect, or consequential loss caused by any delay or failure in delivery except as set out in this condition.
2.3 It is the Customers responsibility to make sure site access is suitable for the item/s ordered. FlexFridge requires advanced measurement and assessment of access sites before delivery. Shall there be aborted delivery caused by access restrictions, it will be chargeable to the Customer.
2.4 Any costs incurred due to inadequate site access shall be charged to the Customer.
2.5 If the Customer fails to deliver the goods, FlexFridge shall be entitled to bill and be paid for the goods as though they had been duly delivered. FlexFridge may arrange storage for the Goods until actual delivery and charge the Customer for the reasonable storage costs.
3.1 The Customer is responsible for inspecting the goods upon delivery. FlexFridge accepts no responsibility for alleged non-delivery, shortfall of goods, or other discrepancies. Shall there be situations like this, the Customer must notify FlexFridge within 24 hours from the date of delivery. In the absence of such notice, FlexFridge shall consider that the Customer has accepted the goods.
3.2 If upon delivery there is damage on the outer packaging or the item itself, the Customer must have the courier sign to this effect and notify FlexFridge after that. Notification of damage after item delivery is complete and signed is not valid for any succeeding claim.
3.3 Signing for the delivery indicates that the Customer has accepted the delivery and agreed the items are in good condition.
4.1 Goods dispatched to the Customer and subsequently accepted for Cancellation by FlexFridge will be subject to a failed delivery charge, as well as any cancellation charge deemed necessary by FlexFridge.
4.2 FlexFridge, at its absolute discretion, may agree to the return of the goods by the Customer provided that it is at the Customer’s expense, in the same condition, and its original packaging as of the date of dispatch by FlexFridge or their agents.
4.3 Any goods agreed by FlexFridge as acceptable for return for any reason (except defective and faulty goods) will be subject to a restocking charge along with reimbursement of any expense incurred by FlexFridge as a consequence of the return of said goods to FlexFridge’s stock.
4.4 FlexFridge will accept no goods for Return 14 days after the delivery date.
5.1 The machine manufacturers supply warranties. Warranties provided by these manufacturers are subject to the manufacturer’s terms and conditions.
5.2 Warranties do not cover or include site services, pipework, cabling, and connections. FlexFridge will not be held liable for any loss or damage or any other compensation claims resulting from warranty issues.
6.1 If the Customer decides to install the product by themselves or sources third party engineers, the Customer accepts responsibility for the work undertaken. FlexFridge will in no part be responsible for the site services, pipework, cabling, and connections.
6.2 The FlexFridge warranty does not cover machine damage caused by the Customer or third-party engineers.
7.1 The Customer agrees that FlexFridge will not be liable for any losses or damage suffered by the Customer, which includes but is not limited to damage to neighboring or nearby items or premises or any loss caused by the use or purchase of the Goods by the Customer. Any additional damage after the Customer fails to report a fault or defect in good time or failure to provide reasonable access to the Goods for repairs, service, or engineer visits is not FlexFridge’s liability. Nothing in this Agreement shall exclude FlexFridge’s statutory liability for injury or death.
7.2 Goods sold are not insured for delivery unless otherwise confirmed by FlexFridge.
